News Alert: NLRB’s Decision Prohibiting “No-Recording” Rules in the Workplace Upheld

Many people are uncomfortable with the idea that their conversations can be secretly recorded. "The ease of recording, coupled with the ability to disseminate recordings almost instantaneously via social media, has prompted many employers to implement “no-recording” policies that prohibit employees from recording others in the workplace without prior consent." The Second Circuit recently affirmed an NLRB ruling "that broad “no-recording policies” are unlawful – for both union and non-union employers like." This week's news alert -- NLRB’s Decision Prohibiting “No-Recording” Rules in the Workplace Upheld from Platinum sponsor Crowell & Moring LLP -- discusses the NLRB and Second Circuit rulings, and offers takeaways for developing policies that comply with those rulings.
