FAS 5 Top Ten Concerns for Corporate Counsel

The FASB’s June 5, 2008 Exposure Draft of proposed FAS 5 amendments will create tremendous and unacceptable burdens on corporate loss contingency reporting requirements, requiring disclosure of substantially more information in financial statements and creating devastating privilege waiver problems. Senator Specter’s Privilege Legislation Demand Backed by ACC
Earlier this month, U.S. Attorney General Michael Mukasey announced to the Senate Judiciary Committee that Deputy Attorney General Mark Filip was crafting new U.S. Department of Justice (DOJ) guidelines that would replace the McNulty Memo and offer "real, significant proposed changes.” The DOJ’s McNulty Memo includes privilege waiver as a criteria for cooperation in the context of DOJ investigations into allegations of corporate failure. Deputy Attorney General Filip issued a letter that offered an executive summary of the memo that is still to come, angering Senator Specter, who called for the DOJ to stop stalling and for the mark-up and passage of The Attorney Client Privilege Protection Act of 2008. The ACC Docket Wins Again (and Again) for Publication Excellence
The ACC Docket garnered seven awards this year for excellence in publication. One of the most recent achievements of the magazine includes its Award of Distinction, awarded by the International Academy of the Visual Arts’ Communicator. Competing with more than 8,000 other entries from around the world, the ACC Docket was selected as a winner after being judged based on various criteria, including best cover design, feature articles, and overall print publication. Top Honors For In-house Counsel Global Accomplishments
Senior in-house counsel from Belgium, Canada, the Netherlands, the U.K. and the U.S. met in New York, NY for the International Law Office (ILO) Global Counsel Awards 2008, hosted by ACC and ILO. Based on more than 2,900 individual nominations, ACC and ILO recognized those in-house counsel and law departments who have excelled in specific practice areas.
Winners include James Buda of Caterpillar Inc., who was named General Counsel of the Year; Wyeth, which received the Pro Bono Award; and ACC Board Member David R. Allgood, who received an individual honor in the Regulatory (Financial) Services category, making him the only Canadian to win the 2008 award (see below). "Product Safety in a Global Marketplace - Current Trends and Future Challenges”
A group of distinguished presenters from Germany, France, the U.K., China and the U.S. gathered in Munich on June 19, to address this topic of great importance and offered up-to-the-minute updates on recent developments on the regulatory front, both EU and global. Among the topics: Chinese product safety -risk management practices; key elements of a successful product recall; responding to and managing a product crisis; the new EU product safety regime currently in practice; and recent developments in U.S. product safety.
