Workplace Privacy In A Web 2.0 World

Because employee privacy rights come from so many sources, understanding and ensuring their protection is an essential skill of in house counsel.  This program was designed to update you on the status of employee privacy rights, with a handout/checklist to refresh your learning about each major element.  

    1.  Preemployment privacy rights (e.g., what can, can't, and must you ask of applicants, and what can and must you search for by way of information).
 
    2.  Testing (including drug, honesty, character, and ability tests). 
 
    3.  Monitoring employee whereabouts (including video, audio, GPS tracking, embedded chips, and the like).
 
    4.  Monitoring employee communications, including Web 1.0 (computer, home computer, email, voicemail, text messaging) and Web 2.0 (blogs, social networking sites, virtual communities, and the like) applications.
 
    5.  Off-work activity (to what extent is this private and off limits from employer regulation?).
 
    6.  Information privacy in employment (medical, psychological, personnel, investigatory, and the like).
 
    7.  References (what can and can't you disclose).
