What Every In House Counsel Needs to Know About Intellectual Property

The costs of retaining top-shelf legal representation to handle bet-the-company litigation or to provide patent prosecution for the company’s intellectual property are increasing dramatically.  Simultaneously, in house counsel are under growing pressure to control costs and still produce results in these tough economic times.  To complicate the equation even further, the patent law is constantly changing, through a constant deluge of court cases, new administrative rules, and legislative initiatives.  This session will discuss a few of the more recent and noteworthy changes in the patent law as well as a variety of methods for the efficient management of outside IP counsel, including methods for controlling costs for litigation, patent prosecution, and due diligence.

Automation and Outsourcing of Review Processes

In today’s economic times, it comes of no surprise that businesses are looking for ways to manage sometimes debilitating legal costs.  Discovery, especially in light of ESI increases, is one area where corporate counsel may find ways to manage these burdens.  The legal industry is a late adopter to newer business trends; however, astute attorneys may find some relief with new techniques.  This presentation will demonstrate some ways to decrease costs and increase discovery efficiencies through automation and outsourcing.

Metrics Mania: Leveraging Law Department Metrics to Manage Costs and Improve Performance

Increasingly, law departments are responsible for more than just practicing law—they are also responsible for efficient and fiscally responsible operations. Managing costs, reducing risk, and improving productivity are all priorities for corporate counsel because law departments are being evaluated against the same standards as other departments within their companies. To meet this challenge, law departments need new tools for measuring value and results. This session will share best practices on using metrics to manage or control costs, evaluate outside counsel performance, increase efficiencies, and communicate the value of the law department to company management.

The Role of Legal Counsel in Risk Management

Much of the recent upheaval and loss in the market is attributed to a failure of risk management. While companies in the financial industry have been adopting formalized risk management programs for years, companies in most other industries frequently approach the subject in a less structured manner. However, in light of the recent failures and as part of an ongoing trend toward improved controls and governance, many companies are evaluating their risk management approach. Because in-house counsel typically serves as one of the lead risk managers in an organization, these attorneys are seeking information about how to improve risk management. This program will provide both a high level overview of risk management concepts and practical insights on how in house attorneys can be effective risk managers.

When a Dispute Becomes a Public Crisis: Strategy and Tips for the In House Counsel Managing the Press

A lawyer, communications expert and former press secretary to a mayor of a major American city, Seth Gitell, will introduce participants to the pressing issues communication challenges present and provide key insight and strategies in dealing with the rapidly changing media environment. Topics to be covered, along with specific case studies, will include attorney-client privilege and the media, on-the-record and off-the-record information, and the importance of working with the media in a challenging, multi-level environment.
