Procter & Gamble’s European Expertise Collaboration Practices: Focus on Value and Leveraging Knowledge

“Value is everything.  It is at the core of our relationships with law firms.  We believe in having a true partnership—it’s really in this spirit that we work,” explains Yves De Bruyne, General Counsel for Europe, Middle East and Africa Operations for Procter & Gamble.

De Bruyne shares that an important first question before deciding to engage outside counsel in a new project is “what value will the law firm and will we bring to this project – and, how shall we complement each other.”  He notes that value can be very different from one project to the next:  in one project, value may mean extra capacity (people); in another, it may be legal expertise; in another, it may be expertise in other areas or networking capabilities or access to information.

ACC Files Amicus Briefs on Corporate Liability and Work Product

On June 28, ACC filed an amicus brief in the D.C. Circuit urging the court to reject the Health and Human Services Secretary’s exclusion of an in-house attorney from federal health care programs, pursuant to the Responsible Corporate Officer Doctrine, arguing that “targeting only in-house lawyers for the wrongdoing of their clients is counterproductive and could be seen by some as targeting lawyers to the detriment of their clients.” To download ACC Amicus, Friedman v. ACC also filed an amicus brief with the U.S. District Court for the District of Minnesota on June 30 in support of a petition to quash an IRS summons in Wells Fargo v. US (Case No. 0:10-mc-57-JRT-JJG). ACC argues that the IRS attempts to obtain tax accrual workpapers - which contain legal analyses of Wells Fargo’s in-house lawyers – poses a threat to work product privilege. Excellence in Corporate Practice Award Nominations Now Being Accepted

ACC is looking for nominees for its 2011 Excellence in Corporate Practice Award.
