Updates From ACC Committees

Message from Miriam Lefkowitz, Financial Services Committee Chair


As the Chair of the Financial Services Committee for 2016, I am excited about the plans we have for the upcoming year. We have an excellent executive committee with members who have diverse backgrounds within the financial services industry.  We have done a lot of work already since October 2015 to plan networking events, our monthly committee meetings, legal resources, and webcasts on relevant issues for various all of us.  Among other goals, we are hoping to increase the opportunities for networking, enhance the relationship with our sponsor law firm, create an open dialogue with the regulators, and make the monthly meetings more relevant to more members.  It is an ambitious plan – but we hope it will add value to our members.

Please join our monthly teleconference calls which are generally held every fourth Wednesday of the month at 3:00 pm ET / 12:00 PT.  We are trying something new this year – which is to include regulatory updates from key financial services regulators (FDIC, Fed, SEC, CTFC, etc.) on the monthly calls, as well as have a section on ACC resources, in addition to a Legal Quick Hit.  Please learn more about our committee at our website, and don’t hesitate to contact us with any questions and comments. CFPB General Counsel Roundtable 2015

On September 24th and 25th, forty members of the ACC Real Estate and Financial Services Committee gathered in Washington, D.C. to meet in a Roundtable format with the Consumer Financial Protection Bureau (CFPB) and Congressional Committees. The members represented a diverse group of companies and industries from throughout the nation.  Prior to the meetings, the Real Estate chair, Dawn Haghighi, and then-chair of the Financial Services Committee, Laura Dorman, hosted in conjunction with the ACC staff and the law firm of Paul Hastings several pre-Roundtable briefing telephone calls for the participants. During the pre-briefing calls, the members identified current and pending CFPB actions and regulations to address during the Roundtables. A very detailed briefing book on current regulatory issues was distributed to all participants.  While at the CFPB Roundtable, ACC members met with various high-level CFPB officials, including Acting Deputy Director and General Counsel Meredith Fuchs.  Issues addressed with the CFPB included the current regulatory agenda and the consumer complaint database, TRID, joint enforcement efforts of the CFPB and the DOJ, Project Catalyst, advisory opinions and disparate impact in fair lending. 

Following the CFPB meetings, ACC members met with staff from both the Senate Banking Committee and the House Financial Services Committee for updates on the legislative agenda concerning the CFPB, and to share their experiences as industries being regulated by the CFPB.  Over eighty ACC members applied to participate in the Roundtable sessions.  To address the strong interest, the Real Estate and Financial Services committees invited all applicants to participate in the pre-briefing sessions, and have created a Regulator/CFPB Working Group. We are also hosting ongoing calls to discuss updates on Regulator and CFPB enforcement efforts, and will be publishing Docket articles and hosting local committee networking events. The FSC hosts member calls typically the fourth Wednesday of every month at 3 pm ET to provide an opportunity to engage with the leadership, to learn about opportunities, and to join Legal Quick Hit presentations from experts with experience in financial services.  Legal Quick Hit presentations are 20-45 minutes in length and cover hot topics that impact our clients.  We look forward to welcoming all members to our meetings.  Missed the call?  No problem!  You can catch up on any FSC announcements, events and Legal Quick Hits you missed here.
