Message from James Dixon - Energy Committee Chair

Welcome to the Energy Committee’s first quarterly newsletter.  Special thanks to Liz Schultz, our Communications Chair, for putting the content together … much appreciated.  I hope you find this newsletter informative; if you have suggestions on format or substance, please send them to me or Liz Schultz

It’s a very good time to be a member of the Energy Committee.  Your Committee leadership team is committed to bringing you current relevant information to help you in addressing the challenges that we face as in-house counsel in the energy space.  I have worked in this area for over 30 years and don’t think that I have witnessed the pace of change that we have seen in all aspects of energy law practice in the past five years.  Whether it’s keeping up with new technologies, legal contracting, regulatory dynamics or just the latest curve ball, the Energy Committee is working to bring you the information you need to deal with it all.

But there is something you can do to help.  We need your input.  Send Stefano de Stefano your ideas for resources that you think may be of interest to Committee members; send Kelly Dvorak ideas for future Legal Quick Hits on the latest issues affecting your practice; reach out to me or Ashlee Effler (your Membership Chair) if you want to get more involved.  It’s your committee; help make the most of it.

One more word of thanks … for the first time the Energy Committee’s membership exceeds 2,000 members thanks to Ashlee’s and Jean-Baptiste (JB) Pessey’s hard work.  For those of you who are unfamiliar with JB, he’s the Energy Committee’s liason and an exceptional resource for learning more about what ACC has to offer.  Feel free to reach out to him or ask a question at our monthly meetings held the third Wednesday of each month at 2:00 PM eastern time.

Are you coming to Boston for the ACC Annual meeting?  I hope so.  It’s a great opportunity to get some legal education, meet new and old friends and have some fun.  Don’t forget to sign up for the Energy Committee lunch on Tuesday, October 20, from 12:45PM - 2:15PM and for the Energy Committee program sessions.  Also, if you get in on Sunday night, kick off the Annual Meeting in style by joining us at the Top of the Hub/Skywalk Observatory for our opening night social (more information to follow).  See you there!

Energy Committee News and Call for Ideas, Volunteers, Authors and Annual Meetings

Membership – Chapter Liaisons

We are actively looking for members willing to serve as “chapter liaisons” to help convey committee information, plan joint events for local committee members, and coordinate more events and local content with chapters. If you are interested in being a chapter liaison for your area, please email our Membership Chair Ashlee Effler. 


The Energy Committee’s mission is to provide materials, training, continuing educational opportunities and resources for ACC members with an interest in the Energy industry. The Committee, which currently comprises more than 2,000 ACC members across the U.S. and around the world, provides a forum for in-house counsel to analyze and discuss recent cases, laws and regulatory actions relevant for their practice. 

If you have not yet taken advantage of the Energy Committee eGroup, we highly recommend that you post your questions and concerns. Members actively share forms, checklists, practice tips and policies on key energy-related topics. You can also search for topics in eGroups to see if other members have had similar issues. ACC has also provided the capability to post you inquiry anonymously. It is a fantastic resource to mine the knowledge of your colleagues. Authors and Ideas

Our members are a prolific group and we are always looking for more aspiring or current authors. If you are interested in authoring or co-authoring a resource, or if you have any ideas for a resource or a topic for a future webcast that you would like the Energy Committee to consider, please contact our Resources Subcommittee Chair Stefano de Stefano.

2015 Annual Meeting Agenda 

As a member of the ACC, you are cordially invited to attend the Energy Committee's programs at ACC's Annual Meeting on Monday, October 19. 

Attend our first session of the day, Session 111 – Boilerplate for Boilermakers: Fundamentals of Energy Project Contracting, from 9:00 – 10:30 AM Eastern. This session is designed to break down the fundamentals of energy project contracts, from the form of the contract itself to an in-depth look at provisions like indemnification, choice of law, limitations of liability, insurance, tax issues and litigation versus alternative dispute resolution. It will provide a checklist of key topics to consider when drafting and negotiating these types of contracts. The panellists will also offer practice tips on how to navigate the treacherous waters of environmental litigation.

Join us for our second session of the day, Session 311 – The Energy Industry From All Sides, from 2:30 – 4:00 PM Eastern. This unique debate-style panel will bring together representatives of different facets of the energy industry, including industry players, environmentalists, consumers and lawmakers, who will discuss and debate some of the major issues facing the industry in the 21st century.

At both of our sessions, you will have an opportunity to meet and network in an informal setting with committee members who represent the entire spectrum of the industry from oil and gas to renewables and utilities to distributed generation, as well as other in-house counsel having an energy practice or interest.

To register for the Energy Committee's programs, select the Energy Committee panel options on Tuesday, October 20, from 12:45PM - 2:15PM when you register for your courses and meals.

2016 Annual Meeting Call for Program Topics 

We are currently soliciting CLE/CPD program ideas for the 2016 ACC Annual Meeting in San Francisco (Oct 16-19, 2016). We would like to hear about topics on which you need more training and/or on topics for which you would like to provide training for other members. All idea submissions can be directed to our Program Chair, Kelly Dvorak.
