Message from Robert Jett - Compliance & Ethics Chair


As the Chairman of the Compliance & Ethics Committee for 2015, I am excited about the plans we have for the upcoming year.  We have an excellent executive committee and have done a lot of work already since October 2014 to plan our monthly committee meetings, legal resources, and  webcasts on relevant issues for all of us.

The goal of the committee is to provide compliance and ethics programs and educational materials to assist you in your practice and foster additional questions, further learning opportunities, or just the chance to learn about a new area of law, or enhance your existing subject matter expertise. 

The key to our committee's success is not only the exceptional executive committee members, but you. As you know, all of the work done for ACC is on a volunteer basis.  So any chance you have to become a participant in one of our monthly Legal Quick Hits, write an article for the ACC Docket, sit on a panel for one of the ACC education programs, I encourage you to speak up, engage and support the committee and the ACC.

Considering CASL: Creating or Altering Your Communications Policy and Procedures

The collective groans were palpable among counsel involved in the Canadian legal community on July 1 when the long-awaited Canadian anti-spam legislation (CASL) went into effect. Many organizations are not sure if this broad and complicated law applies to them, and the name of the legislation is not particularly helpful. The use of the word “spam” is definitely misleading, as the law applies to electronic communications well beyond those that are commonly thought of as such. In fact, the law is highly restrictive, and certain elements of it apply to just about any commercially related message that may be sent from or to an individual in Canada. It also applies to the installation of a program (e.g., a website cookie) to a computer in Canada. Click here to read more.
